سائفر کیس: عمران خان کا ضمانت بعد از گرفتاری کیلئے اسلام آباد ہائیکورٹ سے رجوع

اسلام آباد:اٹک جیل میں قید چیئرمین تحریک انصاف عمران خان نے سائفر کیس میں ضمانت بعد از گرفتاری کے لیے اسلام آباد ہائی کورٹ میں درخواست دائر کردی۔
بیرسٹر سلمان صفدر کے ذریعے سائفر کیس میں ضمانت بعد از گرفتاری کے لیے اسلام آباد ہائی کورٹ سے رجوع کرنے کے حوالے سے یہ پیش رفت ایسے وقت میں سامنے آئی ہے جب 2 روز قبل آفیشل سیکرٹ ایکٹ کے تحت قائم خصوصی عدالت نے سابق وزیر اعظم کی درخواست ضمانت مسترد کردی تھی۔درخواست میں چئیرمین پی ٹی آئی نے مؤقف اپنایا کہ استغاثہ نے بدنیتی پر مبنی مقدمہ درج کیا، 14 ستمبر کو آفیشل سیکرٹ ایکٹ کی خصوصی عدالت نے درخواست ضمانت مسترد کی۔اس میں کہا گیا ہے کہ خصوصی عدالت نے بے ضابطگیوں اور استغاثہ کے متعدد تضادات کو مکمل طور پر نظر انداز کیا، استدعا ہے کہ اسلام آباد ہائی کورٹ کیس کے حتمی فیصلے تک ضمانت بعد از گرفتاری منظور کرے۔
یاد رہے کہ 2 روز قبل اسلام آباد کی خصوصی عدالت نے سفارتی سائفر سے متعلق آفیشل سیکرٹ ایکٹ 1923 کے تحت درج مقدمے میں عمران خان اور پارٹی کے وائس چیئرمین شاہ محمود قریشی کی درخواست ضمانت بعد از گرفتاری مسترد جب کہ سابق وفاقی وزیر اور پی ٹی آئی کے سینئر رہنما اسد عمر کی ضمانت قبل از گرفتاری منظور کرلی تھی۔
واضح رہے کہ یہ کیس سفارتی دستاویز سے متعلق ہے، جو مبینہ طور پر عمران خان کے قبضے سے غائب ہو گئی تھی، اسی کیس میں چیئرمین پی ٹی آئی اور وائس چیئرمین پی ٹی آئی 26 ستمبر تک جوڈیشل ریمانڈ پر جیل میں ہیں۔
پی ٹی آئی کا الزام ہے کہ اس سائفر میں عمران خان کو اقتدار سے ہٹانے کے لیے امریکہ کی جانب سے دھمکی دی گئی تھی، پی ٹی آئی کے چیئرمین عمران خان اور وائس چیئرمین شاہ محمود قریشی بھی اسی کیس میں ریمانڈ پر ہیں۔
ایف آئی اے کی جانب سے درج فرسٹ انفارمیشن رپورٹ (ایف آئی ار) میں شاہ محمود قریشی کو نامزد کیا گیا اور آفیشل سیکرٹ ایکٹ کی دفعات 5 (معلومات کا غلط استعمال) اور 9 کے ساتھ تعزیرات پاکستان کی سیکشن 34 کے تحت مقدمہ درج کیا گیا۔
ایف آئی آر میں 7 مارچ 2022 کو اس وقت کے سیکریٹری خارجہ کو واشنگٹن سے سفارتی سائفر موصول ہوا، 5 اکتوبر 2022 کو ایف آئی اے کے شعبہ انسداد دہشت گردی میں مقدمہ درج کیا گیا تھا، جس میں سابق وزیر اعظم عمران خان، شاہ محمود قریشی اور اسد عمر اور ان کے معاونین کو سائفر میں موجود معلومات کے حقائق توڑ مروڑ کر پیش کرکے قومی سلامتی کو خطرے میں ڈال کر اپنے ذاتی مفاد کے حصول کی کوشش پر نامزد کیا گیا تھا۔اس میں کہا گیا کہ سابق وزیراعظم عمران خان، سابق وزیر خارجہ شاہ محمود قریشی اور ان کے معاونین خفیہ کلاسیفائیڈ دستاویز کی معلومات غیر مجاز افراد کو فراہم کرنے میں ملوث تھے۔
