شاہنواز حسین نے آبروریزی کے الزام کے خلاف سپریم کورٹ سے رجوع کیا

نئی دہلی: بھارتیہ جنتا پارٹی (بی جے پی) کے سینئر رہنما اور سابق مرکزی وزیر شاہنواز حسین نے 2018 میں اپنے خلاف مبینہ عصمت دری کے معاملے میں ایف آئی آر درج کرنے کے ٹرائل کورٹ کے حکم کو برقرار رکھنے والے اس فیصلے کو جمعرات کو سپریم کورٹ میں چیلنج کیا۔
جسٹس این۔ وی رمنا کی سربراہی والی بنچ کے سامنے مسٹر حسین کے وکیل نے خصوصی ذکر کے دوران سابق مرکزی وزیر کی درخواست پر جلد سماعت کی درخواست کی۔ بنچ نے اگلے ہفتے اس معاملے پر غور کرنے پر اتفاق کیا۔
ہائی کورٹ کی جج جسٹس آشا مینن کی سنگل بنچ نے بدھ کو دہلی پولیس پر سخت تبصرہ کرتے ہوئے کہا کہ ایسا لگتا ہے کہ پولیس اس معاملے میں ایف آئی آر درج کرنے کے لیے تیار نہیں ہے۔ عدالت نے اس معاملے میں ایف آئی آر درج کرنے کا جو حکم دیا ہے وہ درست ہے۔ ہائی کورٹ کے سنگل بنچ نے مسٹر حسین کے خلاف ایف آئی آر کے اندراج، تین ماہ میں تفتیش مکمل کرنے اور ضابطہ فوجداری کی دفعہ 173 کے تحت تفصیلی رپورٹ درج کرنے کی ہدایت دی تھی۔
عدالت نے سابق مرکزی وزیر کی طرف سے دائر درخواست کو خارج کر دیا تھا، جس میں خصوصی جج کے 12 جولائی 2018 کے حکم کو چیلنج کیا گیا تھا، جس نے ایف آئی آر کے اندراج کے میٹروپولیٹن مجسٹریٹ کے احکامات کے خلاف ان کی نظرثانی کی درخواست کو خارج کر دیا تھا۔
درخواست گزار حسین کے خلاف جون 2018 میں دہلی کی ایک خاتون کی طرف سے ایک شکایت درج کرائی گئی تھی جس میں انڈین پینل کوڈ (آئی پی سی) کی دفعہ 376 (ریپ)، 120-بی (مجرمانہ سازش) اور 506 (مجرمانہ دھمکی) کے تحت جرم کرنے کا الزام لگایا گیا تھا۔ خاتون نے الزام لگایا کہ بی جے پی لیڈر نے مبینہ طور پر اس کی عصمت دری کی اور جان سے مارنے کی دھمکی دی۔
شکایت کنندہ نے بعد میں عدالت میں ایک عرضی دائر کی جس میں دہلی پولیس کو ایف آئی آر درج کرنے کی ہدایت دینے کی درخواست کی گئی۔
ہائی کورٹ کے جھٹکے کے بعد بی جے پی لیڈر نے سپریم کورٹ سے رجوع کیا ہے۔ انہوں نے اپنی اسپیشل لیو پٹیشن میں دلیل دی کہ ہائی کورٹ اس حقیقت کو ذہن میں رکھنے میں ناکام رہی ہے کہ درخواست گزار کو غلط اور غیر قانونی طور پر خاتون شکایت کنندہ کی طرف سے ایک غلط مقصد کے ساتھ کیس میں پھنسایا گیا تھا۔
